Mobile Message Service Terms and Conditions

1. Program Description

Bold Aviator (“Bold Aviator,” “we,” “us,” or “our”) operates a mobile message service (the “Service”) that allows customers to receive text messages related to our products, promotions, and brand. By opting in to the Service, you agree to these Mobile Message Service Terms and Conditions (“Mobile Terms”). Your use of the Service constitutes your agreement to these terms.

We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time. Continued enrollment in the Service following any changes constitutes your acceptance of the revised terms.


2. Types of Messages

By opting into the Service, you may receive:

  • Promotional and marketing messages (e.g., new product launches, limited-time offers, seasonal sales, and exclusive discounts)
  • Transactional and informational messages (e.g., order confirmations, shipping updates, cart reminders)
  • Program-related messages (e.g., opt-in confirmations, opt-out confirmations, HELP responses)

3. How to Opt In

You may opt in to the Service by:

  • Submitting your mobile phone number through an opt-in form on our website or Klaviyo-powered signup form
  • Texting a keyword to our designated number as advertised
  • Checking an SMS consent box at checkout or on a landing page

By opting in, you expressly consent to receive text messages from Bold Aviator at the phone number you provided. Consent is not a condition of any purchase.


4. Message Frequency

Message frequency varies. We may send multiple messages per month based on the types of messages you subscribed to. Message frequency may increase during promotional periods or product launches.


5. Message and Data Rates

Message and data rates may apply.

Standard messaging and data rates charged by your mobile carrier may apply to messages you send and receive. Bold Aviator is not responsible for any charges from your wireless carrier.


6. How to Opt Out (STOP)

To cancel, reply STOP to any message at any time.

After texting STOP, you will receive a one-time confirmation message and will be unsubscribed from the Service. No further messages will be sent unless you re-enroll. You may also unsubscribe by clicking the unsubscribe link (where available) in any text message.

7. How to Get Help (HELP)

For help, reply HELP to any message or contact us at hello@boldaviator.com.

After texting HELP, you will receive a response with the program description, our contact information, and instructions for how to opt out.


8. Supported Carriers

The Service is available on most major U.S. wireless carriers. Supported carriers include, but are not limited to: AT&T, T-Mobile/Sprint, Verizon Wireless, Boost Mobile, Boost Infinite, Consumer Cellular, Cricket Wireless, Google Fi, Metro by T-Mobile, Mint Mobile, Straight Talk, TracFone, US Cellular, and Xfinity Mobile.

Carrier participation may change without notice. Carriers are not liable for delayed or undelivered messages.


9. Privacy

We will handle any personal information you provide in connection with the Service in accordance with our Privacy Policy, available at boldaviator.com/privacy/.

We will not share your phone number or SMS opt-in data with nonaffiliated third parties for their marketing or advertising purposes. See our Privacy Policy for full details on how we collect, use, and protect your information.


10. Eligibility

The Service is available to subscribers who are 13 years of age or older. By opting in, you confirm that you are the account holder for the mobile number provided or that you have the account holder’s permission to enroll.


11. Limitation of Liability

TO THE EXTENT PERMITTED BY APPLICABLE LAW, BOLD AVIATOR IS NOT LIABLE FOR ANY FAILED, DELAYED, OR MISDIRECTED DELIVERY OF ANY INFORMATION SENT THROUGH THE SERVICE; ANY ERRORS IN SUCH INFORMATION; ANY ACTION YOU MAY OR MAY NOT TAKE IN RELIANCE ON THE INFORMATION OR SERVICE.


12. Changes to These Terms

We may update these Mobile Terms at any time. Changes become effective when posted. Your continued use of the Service after changes are posted constitutes your acceptance of the new terms. We encourage you to review these terms periodically.
